  • Telnyx: SMS/text messaging services for transactional notifications (booking confirmations, trip reminders, driver updates). Phone numbers are shared only with explicit opt-in consent and are used solely for service-related communications.

These service providers are contractually obligated to protect your information and use it only for the purposes we specify.

4.2 Legal Requirements

We may disclose your information if required by law or in response to valid requests by public authorities (e.g., court orders, subpoenas).

4.3 Business Transfers

In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.

We may share your information with your explicit consent or at your direction.

5. Data Security

We implement appropriate technical and organizational measures to protect your information, including:

6.1 Active Accounts

For active accounts, we retain all data associated with your account for the duration of your subscription.

6.2 Cancelled Accounts

After subscription cancellation:

  • Data is retained for 30 days to allow for account reactivation
  • After 30 days, data may be archived or deleted in accordance with our Terms of Service
  • Some information may be retained longer if required by law or for legitimate business purposes

We may retain certain information for longer periods if required by law, regulation, or legal process.

7.1 Access and Correction

You can access and update your account information at any time through the Service's settings.

7.2 Data Export

You can export your data through the Service's export features. We recommend exporting your data before canceling your subscription.

7.3 Account Deletion

You can request deletion of your account by contacting us. We will delete your account and associated data in accordance with our data retention policies and legal obligations.

7.4 Cookies

Most web browsers are set to accept cookies by default. You can adjust your browser settings to refuse cookies, but this may limit your ability to use certain features of the Service.

7.5 Marketing Communications

You can opt out of marketing emails by following the unsubscribe instructions in those emails. Service-related communications (e.g., account updates, security alerts) cannot be opted out of.

7.6 SMS Notifications (Message Program)

Our SMS program sends transactional notifications about your transportation bookings (confirmations, reminders, driver updates). Message frequency may vary; typically up to 5–6 messages per booking cycle. Message and data rates may apply as determined by your mobile carrier. Consent is not a condition of purchase.

How to opt in (mobile opt-in path):

  • Booking portal: Go to https://onyxdispatch.us/booking, complete the booking form, enter your mobile number, check the "I agree to receive SMS notifications" checkbox, and submit. You will receive a confirmation SMS.
  • Account settings: Go to https://onyxdispatch.us/account/settings and turn the "Enable SMS Notifications" switch ON. You will receive a confirmation SMS.
  • Keyword opt-in: Text START, YES, SUBSCRIBE, or OPTIN to our program number (advertised at the booking portal). You will receive a confirmation SMS.

STOP instructions (how to opt out): You may opt out at any time by replying STOP, UNSUBSCRIBE, QUIT, END, or CANCEL to any SMS message. You will receive one confirmation message and then no further messages. You may also opt out in your account settings by disabling SMS notifications. Opt-out requests are processed immediately.

HELP instructions: For help at any time, reply HELP to any SMS message. You will receive an auto-response with contact information (website and email) for support.

You can opt back in at any time by replying START, YES, SUBSCRIBE, or OPTIN, or by enabling SMS notifications in your account settings. We do not sell or share your mobile information with third parties for promotional or marketing purposes. This Privacy Policy, including Section 10 (SMS and Text Messaging Services), serves as the message program privacy policy for our SMS program and describes how we collect, use, and protect information in connection with it.

8. Children's Privacy

The Service is not intended for individuals under the age of 18. We do not knowingly collect personal information from children. If you become aware that a child has provided us with personal information, please contact us, and we will delete such information.

9. International Data Transfers

Your information may be transferred to and processed in countries other than your country of residence. These countries may have data protection laws that differ from those in your country. By using the Service, you consent to the transfer of your information to these countries.

10. SMS and Text Messaging Services (Message Program Privacy Policy)

This section is the message program privacy policy for our SMS/text messaging program. It describes how we collect, use, and protect your information in connection with SMS notifications for transportation bookings.

10.1 SMS Service Provider

We use Telnyx, a third-party SMS service provider, to send transactional text messages related to your transportation bookings. Telnyx processes SMS messages on our behalf in compliance with applicable telecommunications regulations, including TCPA (Telephone Consumer Protection Act) requirements.

10.2 Message Frequency and Rates

Message frequency may vary. You may receive up to approximately 5–6 messages per booking cycle (e.g., booking confirmation, acceptance, trip reminders, driver status updates, completion). We do not send marketing or promotional SMS. Message and data rates may apply as determined by your mobile carrier. Consent to receive SMS is not a condition of purchase.

10.3 Opt-In Path (How to Subscribe)

You may opt in to SMS notifications by:

  • Booking portal: Visiting https://onyxdispatch.us/booking, completing the booking form with your mobile number, checking the SMS opt-in checkbox, and submitting. A confirmation SMS will be sent.
  • Account settings: Visiting https://onyxdispatch.us/account/settings and turning the "Enable SMS Notifications" switch ON. A confirmation SMS will be sent.
  • Keyword: Sending START, YES, SUBSCRIBE, or OPTIN to our program number (shown at the booking portal). A confirmation SMS will be sent.

10.4 STOP Instructions (How to Opt Out)

To opt out at any time, reply STOP, UNSUBSCRIBE, QUIT, END, or CANCEL to any SMS. You will receive one confirmation message and then no further messages. You may also opt out via account settings by disabling SMS notifications.

10.5 HELP Instructions

For help, reply HELP to any SMS message. You will receive an auto-response with our contact information (website and email) for support.

10.6 Information Collected for SMS

To provide SMS notifications, we collect and store:

  • Phone Numbers: Mobile phone numbers you provide when opting in to SMS notifications
  • Opt-In Status: Your SMS opt-in preference and timestamp of consent
  • Opt-Out Status: If you opt out, we record the opt-out timestamp to ensure compliance
  • Message History: Records of SMS messages sent (for service delivery and compliance purposes)

10.7 How We Use SMS Data

We use your phone number and SMS preferences solely for:

  • Sending transactional notifications about your bookings (confirmations, reminders, driver updates)
  • Processing opt-in and opt-out requests

We do not:

  • Not use your information for their own marketing purposes

10.9 SMS Data Retention

We retain SMS-related data (phone numbers, opt-in/opt-out timestamps) for as long as necessary to provide SMS services and comply with legal obligations. If you opt out, we retain the opt-out record to ensure we do not contact you again unless you opt back in.

10.10 SMS Compliance

Our SMS services comply with:

  • TCPA (Telephone Consumer Protection Act): We only send SMS to numbers where we have obtained explicit opt-in consent
  • 10DLC Regulations: Our SMS campaigns are registered and approved through proper 10DLC channels
  • Opt-Out Requirements: Every SMS includes opt-out instructions, and opt-out requests are processed immediately
